1. About these terms
These Terms and Conditions ("Terms") govern your use of SalaryCrush, a salary benchmarking and reporting tool operated by Gwat Tech ("we", "us", "our"), a company registered in England and Wales (company number: [XXXXXXXX]).
By creating an account or using SalaryCrush, you agree to these Terms. If you do not agree, you must not use the service.
These Terms are governed by the laws of England and Wales.
2. Eligibility
You may use SalaryCrush if you:
- ✓ Are at least 16 years old
- ✓ Are accessing the service for personal, non-commercial use unless you hold a business subscription
- ✓ Have the legal capacity to enter into a binding agreement
- ✓ Are not prohibited from using the service under any applicable law
We reserve the right to refuse access to anyone at our discretion.
3. Your account
You are responsible for:
Providing accurate information when registering
Keeping your login credentials secure and confidential
All activity that takes place under your account
You must notify us immediately at security@gwattech.co.uk if you suspect unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account where you have failed to keep your credentials secure.
You may only hold one account. Creating duplicate accounts is not permitted.
4. Acceptable use
You agree to use SalaryCrush only for lawful purposes and in accordance with these Terms. You must not:
Use the service in any way that is unlawful, fraudulent, or harmful
Input false, misleading, or fabricated salary data with the intent to manipulate benchmarks
Attempt to gain unauthorised access to any part of the service or its underlying systems
Reverse engineer, decompile, or attempt to extract the source code of SalaryCrush
Scrape, copy, or reproduce any data, content, or benchmarks from the service
Share your account credentials with any other person
Use automated tools, bots, or scripts to access or interact with the service
Resell, sublicense, or commercially exploit the service without our written permission
Upload or transmit any malicious code, viruses, or harmful content
We reserve the right to suspend or terminate your account if you breach any of the above.
5. Subscriptions and payment
Free tier
SalaryCrush may offer a free tier with limited features. Access to the free tier does not require payment but remains subject to these Terms.
Paid subscriptions
Paid plans are billed on a monthly or annual basis. By subscribing, you authorise us to charge your payment method via Stripe on a recurring basis until you cancel.
Failed payments
If a payment fails, we will notify you and attempt to retry. If payment remains outstanding after 7 days, we reserve the right to suspend access to paid features until the account is brought up to date.
Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.
Refunds
We do not offer refunds for partial billing periods already in progress. If you believe you have been charged in error, contact us at billing@gwattech.co.uk within 30 days of the charge.
Price changes
We reserve the right to change subscription pricing. We will give you at least 30 days' notice of any price increase. Continued use after the notice period constitutes acceptance of the new pricing.
6. Your data
You retain ownership of all personal data and salary information you input into SalaryCrush. By using the service, you grant us a limited licence to process that data solely for the purpose of providing the service to you.
We handle your personal data in accordance with our Privacy Policy, which forms part of these Terms.
Anonymised benchmarking data
To power salary benchmarks and market comparisons, we may use anonymised, aggregated data derived from user inputs. This data cannot identify you or any individual user. It is used solely to improve the accuracy and usefulness of benchmarking features.
7. Intellectual property
SalaryCrush, including its design, code, content, benchmarking methodology, and all related materials, is owned by Gwat Tech and protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
You are granted a limited, non-exclusive, non-transferable licence to use SalaryCrush for its intended purpose during the period your account is active. This licence does not permit you to copy, modify, distribute, or create derivative works from any part of the service.
8. Disclaimers
Important
SalaryCrush is an informational tool. All salary data, benchmarks, and reports are provided for general reference purposes only and do not constitute financial, legal, or career advice.
We do not guarantee the accuracy, completeness, or timeliness of any benchmark data. Salary markets vary by region, sector, and employer, and benchmarks are indicative only. You should not rely solely on SalaryCrush when making employment, salary negotiation, or financial decisions.
The service is provided "as is" and "as available". We make no warranties, express or implied, regarding the service's fitness for a particular purpose, uninterrupted availability, or freedom from errors or bugs.
9. Limitation of liability
To the fullest extent permitted by law:
Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the total amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.
We are not liable for any indirect, consequential, incidental, or special loss, including lost profits, lost data, loss of goodwill, or business interruption.
We are not liable for any decision you make based on salary data, benchmarks, or reports produced by SalaryCrush.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Availability and changes to the service
We aim to keep SalaryCrush available but do not guarantee uninterrupted access. We may carry out maintenance, updates, or improvements that temporarily affect availability. Where possible, we will give advance notice of planned downtime.
We reserve the right to modify, suspend, or discontinue any feature or aspect of the service at any time. If we make a material change that significantly affects your use of the service, we will provide reasonable notice.
11. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and/or by a prominent notice within SalaryCrush at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
12. Termination
By you
You may close your account at any time through your account settings or by contacting us at support@gwattech.co.uk. On closure, your personal data will be handled in accordance with our Privacy Policy.
By us
We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent or harmful activity, or where required by law. We may also terminate inactive free-tier accounts after 12 months, with prior notice.
On termination, your licence to use the service ends immediately.
13. Governing law and disputes
These Terms and any dispute arising from them are governed by the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales.
If you have a complaint or dispute, please contact us first at support@gwattech.co.uk and we will do our best to resolve it informally before either party pursues formal proceedings.
